1. Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Belova (“we,” “us” or “our”), concerning your access to and use of the "Belova: AI Girlfriend & Chat" application (the “Application”). You agree that by accessing the Application, you have read, understood, and agreed to be bound by all of these Terms 23of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED24 FROM USING THE APPLICATION AND YOU MUST DISCONTINUE USE IMMEDIATELY.25

1. Age Requirement26

By using this Application, you represent and warrant that you are at least 17 ye27ars of age. The Application contains themes and interactions intended for a mature audience.

1. User Generated Content (UGC) and AI Interaction

The Application utilizes Artificial Intelligence to generate text and image responses.

• Content Restrictions: You are strictly prohibited from using the Application to generate content that is: illegal, violent, sexually explicit involving minors, defamatory, harassing, or promotes hate speech.

• Reporting Mechanism: Users can flag or report inappropriate content generated by the AI or other users by using the "Report" button located within the chat interface. We will review such reports within 24 hours and take appropriate action, including banning users who violate these policies.

• Disclaimer: The characters in Belova are fictional simulations. Responses are generated by AI and do not represent the views or opinions of the developers. The AI may occasionally produce incorrect or biased information.

1. Apple Subscription Terms (Auto-Renewal)

Belova offers subscription plans (e.g., Weekly, Monthly, Yearly) that grant access to premium features such as unlimited messaging and advanced image generation.

• Payment: Payment will be charged to your iTunes Account at confirmation of purchase.

• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.

• Account Charging: Your account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal.

• Management: Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.

• Cancellation: No cancellation of the current subscription is allowed during the active subscription period.

• Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

1. Intellectual Property Rights

Unless otherwise indicated, the Application is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Application (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

1. User Representations

By using the Application, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you will not use the Application for any illegal or unauthorized purpose.

1. Limitation of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APPLICATION.

These Terms shall be governed by and defined following the laws of the jurisdiction in which the developer is based. Belova and yourself irrevocably consent that the courts of that jurisdiction shall have exclusive jurisdiction to 29resolve any dispute which may arise in connection with these terms.
